Terms of Use

These terms govern your use of internetpierce.com (the "Site"), operated by Pierce Ginzberg ("Pierce," "I," "me," or "my"). Using the Site means you accept them. If you don't, don't use the Site. These terms cover the Site itself. A signed engagement with Electrik Kettle for paid services runs on that agreement, not on this page.

1. Changes to the Site or These Terms

I can change, pause, or retire any part of the Site at any time, and I can revise these terms as the Site or my services change. The date at the top shows the most recent revision. Using the Site after a change means you accept the updated terms.

2. Use of the Site

You may read and use the Site for what it's built for: learning what I do and getting in touch. I grant you a limited, non-exclusive, non-transferable license to do that. You may not copy, scrape, republish, or resell the Site's content for commercial purposes without my written permission.

3. Intellectual Property

The Site's text, design, logo, and images belong to me or are licensed to me, and copyright and trademark law protects them. Nothing on the Site hands you any ownership or license beyond the limited use in Section 2.

4. User Submissions

When you submit the contact form, you confirm that what you send is accurate and yours to share. Don't send false information, or anything unlawful, abusive, or infringing. I handle what you send according to the Privacy Policy.

5. Prohibited Uses

You agree not to use the Site for any unlawful purpose, try to gain unauthorized access to it or the systems behind it, interfere with its normal operation through bots, scrapers, or automated scripts, or impersonate anyone in your use of it, the contact form included.

6. No Professional Advice

The Site describes marketing services and shares general commentary. It is not marketing, legal, financial, or business advice for your specific situation, and reading it creates no client relationship. A client relationship starts only with a signed engagement.

7. Third-Party Links

The Site links to Electrik Kettle, Detrás Co., social profiles, and a scheduling tool. I don't control those destinations and I'm not responsible for their content, accuracy, or practices. A link is not an endorsement.

8. Disclaimer of Warranties

The Site comes "as is" and "as available," with no warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. I don't guarantee that it will run uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent the law allows, I am not liable for any indirect, incidental, or consequential damages arising from your use of the Site. The Site is a free informational resource, so my total liability for any claim tied to it is capped at $100. This cap does not apply to a separate signed engagement for paid services, which carries its own terms.

10. Indemnification

You agree to defend and hold me harmless from any claim arising out of your misuse of the Site or your breach of these terms.

11. Governing Law

Florida law governs these terms, without regard to its conflict-of-law rules. Any dispute arising from these terms or the Site will be resolved in the state or federal courts located in Florida.
